Competition Commission revised provisional findings in movies on pay TV market investigation

On 23 May 2012, the UK Competition Commission (CC) issued a revised provisional findings report in relation to its investigation into movies on Pay TV. The CC revised its previous analysis and noted that recent market developments – notably in respect of over the top (OTT) subscription video on demand services by such providers as Netflix and LOVEFilM and the proposed launch of an OTT service by Sky – have led it to the provisional conclusion that Sky’s position in relation to the acquisition and distribution of first subscription pay TV window (FSPTW) movie content on Pay TV does not adversely affect competition amongst Pay TV retailers. This report follows from the CC’s provisional findings published in August 2011 and its subsequent working paper in respect of the impact of recent developments published in March 2012.
