On 9 May 2011, the Electronic Communications and Wireless Telegraphy Regulations 2011 (SI 2011/1210) were published. These implement the European Directive 2009/140, and aspects of the European Directive 2009/136. The Regulations reflect the UK government’s decisions on the implementation of the revised EU electronic communications framework that takes effect from 26 May 2011. Amongst others, the amendments relate to Ofcom’s duties and power to impose penalties and other remedies, new provisions relating to technology and service neutrality and liberalisation of spectrum usage rights.
